IRS Bankrupcy Policy
I had always been under the impression that debts
to the Internal Revenue Service (IRS) could not be
discharged through bankruptcy. However, I have now
learned, throught Don MacPherson, a Phoenix lawyer,
that such is not the fact.
Before 1966, such debts could not be liquidated
by this method; but in that year the Congress enacted
a law which, by rather complicated procedures carefully
observed, enables an unfortunate taxpayer to rid
himself forever of an unpayable debt and thus give him
a new financial start in life.
MacPherson states that there are at least 2 million
persons in the United States who have serious problems
with the IRS; and one fact is certain; The agency will
not voluntarily supply the beleagured taxpayer with the
information through which he might extricate himselve
from his dilema. Instead, as in so many other areas of
tax law, it either ignores the taxpayer's needs or gives
him "disinformation".
Thus, again it is shown that an arm of the government
which should be of help, as well as an enforcer of law,
operates in quite a different manner.
MacPherson himself admits candidly that he thought
debts to the IRS could not be discharged through bankruptcy
until a certain pilot, an old frend of his, apprised him
of the truth. This has been one of the carefully nurtured
secrets of the IRS, which can be compelled to obey the
law only when the taxpayer knows fully what it is.
When he learned this, MacPherson began a careful research,
had been helping clients rid themselves of such terrible
encumbrances.
However, he and the firm of which he is a member are
the only ones in the country who are making this information
available to the public.
